试论社区矫正中的惩罚监管

社区矫正作为非监禁刑罚执行方式,应体现刑罚的本质属性——惩罚性。在社区矫正中,应以惩罚监管为核心,兼顾教育矫正与帮困扶助的矫正作用。但在试点期间,由于各种原因,使一系列惩罚监管措施在实施期间出现了各种难题,导致其并没有充分、合理地适用,使惩罚性在社区矫正中的体现削弱,这不仅有悖于刑法的目的和任务,弱化了刑法预防、惩治犯罪的功能,而且可能导致社会公众尤其是受害人对社区矫正制度的质疑或否定。因此应当高度重视这一现象,认真研究并采取对策予以纠正,确保社区矫正试点工作顺利实施。

Thinking about Punishment Regulation of Community Correction

As a means of non- jailed execution of punishment,community correction should reflect that the essential attribute of punishment is punitive. The punishment regulation should be the core of community correction. We should give attention to education correction and assistance method. However,during the pilot period,various reasons bring a series of penalty regulations to all sorts of problems. It makes the punishment regulations could not get reasonably and fully utilized,and the punitive reflect weakened in community correction,which not only goes against objective and task of the criminal law,it weaken the function of prevention and punishment of the criminal law,but also lead to the social public,especially the victim doubt or deny the community correction system. So we should attach great importance to this phenomenon,seriously study and take measures to correct it to ensure the smooth implementation of the pilot work of community correction.
