| 摘 要： | 通过《自由大宪章研究》一书,我们可以离析出英国早期宪政的三个因素:封建即契约、契约下的自治,契约冲突的解决。这一契约在性质上主要属于政治契约,在于规范国王与贵族。当生产力发展之后,经济契约向全社会扩张,其所要求的政治权利与中世纪早期发展起来的政治契约一起融合为新的社会契约、近现代宪法契约。

| Abstract: | WE can isolate three factors on early British constitutionalism through the book of the Research on Magna Carta:Feudal ie contract, autonomy under the contract, the resolve of the contract conflict. This contract is mainly in the nature of the political contract, and its goal is to specify the king and the nobles. After the development of the productive forces and the economical contract expand to the whole society, the bourgeois require political rights to enjoy the power. So the contract on economical and the feudal become the social contract/constitutional contract in modern society. |
