劳动争议诉讼举证责任分配

如果承认劳动关系不同于民事关系,劳动争议不同于民事争议,那么就必须承认建立在平等主体之上的人身关系和财产关系的民事诉讼举证责任的分配,不同于建立在不平等基础之上的劳动关系的劳动争议诉讼举证责任的分配。但是,我国劳动争议诉讼举证责任分配的理论研究和法律规定,仍然没有摆脱民事诉讼举证责任分配的影响和制约,严重地损害了劳动争议诉讼双方当事人的利益,尤其是损害了劳动者的利益。因此,应当根据劳动争议诉讼的特点,研究劳动争议诉讼举证责任的分配理论架构。

Allocation of Onus Probandi in Labour Disputes Lawsuits

If we admit that labour relations are different from civil relations,labour disputes are different from civil disputes,we have to acknowledge that the allocation of onus probandi in civil lawsuits of equality-based person relations and property relations are different from that of inequality-based labour relations.However and regrettably,the theoretical studies and laws and regulations of the allocation of onus probandi in labour disputes lawsuits are still affected and constrained by that of civil disputes lawsuits,which has greatly harmed the interests of both parties in labour disputes lawsuits,especially the labourer.Therefore,theoretical framework of allocation of onus probandi in labour disputes lawsuits should be studied according to the characteristics of labour disputes lawsuits.
