试论证券民事赔偿机制的建立与完善

随着我国证券市场的飞速发展 ,证券市场所存在的法律真空也呈现出来 ,只有刑事责任和行政责任的法律规制已经明显不足 ,《1·9规定》对虚假陈述行为引起的民事赔偿案件进行了明确规定 ,标志着我国证券民事赔偿机制初步建立。根据我国证券市场的发展情况 ,还应继续借鉴其他国家和地区的立法经验 ,对内幕交易、操纵市场、欺诈客户等侵权行为也加以规制 ,以完善我国的证券民事赔偿机制

On the Establishing and Perfecting of China's Civil Compensation System of Security Tort

With the rapid strides in the security market in our country, the law vacuum in the security market appeared. The legal system only consisting of criminal liability and administrative liability has proved to be obviously inadequate. Judicial interpretation on January 9th defines clear and definite provisions on the civil cases of compensation caused by false statement, which indicates the preliminary establishment of China's civil compensation system of security tort. In order to perfect this system, we should, according to the development of the security market in our country, make further laws on insider trading, manipulating market and fraudulent acts by continuously drawing on the experience of other countries and regions' legislation.
