| 摘 要： | 商事严格责任是商事交易安全原则的基本内容之一。本文以我国学者对商事严格责任理论学说的梳理和评析为路径,对商事严格责任进行阐释。商事严格责任是指在商事立法中,为维护交易的安全,对于交易双方之当事人,分别课以特别严格之责任。商事严格责任所言的内涵与民事责任严格责任规则原则有重大区别,它强调的是对商主体义务要求的严格,是商事立法中贯彻的一种理念。
