| 摘 要： | 法院参与社会管理创新的关键是创新纠纷解决制度,执行和解制度的设计初衷是为了更好解决执行难问题,但是目前执行和解的法律规定似乎不尽合理。为了更好地适应执行需要,应当在对目前执行和解制度进行重构的同时,充分发挥法院的司法能动性。

| Abstract: | The key of the court participating in the social management innovation is innovative dispute resolution systems,The enforcement of the settlement system isto address the problem of difficult enforcement,but the execution of the law about reconciliation seems not reasonable.In order to adapt to the need of the execution,The author thinks we should reconstruct the executive reconciliation system at the same time,and give full play to the court of justice initiative. |
