| 摘 要： | 宪法解释对于一国宪政具有重要意义,而宪法解释权的归属则是宪法解释的首要问题.我国目前将宪法解释权归属于全国人大、全国人大常委会,但从理论及实践上来看,两者均不具备将宪法解释权归属于己的必要条件,因此,必须从宪法解释、宪法解释权自身的特点出发,结合立法本身规律,去寻求更为合适的宪法解释权的归属主体.
