论《刑法修正案（八）》对累犯制度的修改

《刑法修正案（八）》对累犯制度作了较大的修改,规定了未满十八周岁的人不构成累犯,扩大了特殊累犯的成立范围,对判处死缓的累犯限制减刑,这一修改集中体现了宽严相济的刑事政策,体现了与国际社会刑事立法的接轨,刑法立法应适度限定特殊累犯的成立范围,排除老年人构成累犯,将毒品犯罪纳入特别累犯的范围,增设单位累犯制度。
