| 摘 要： | 人民法院在审理专利案件时,应根据我国经济发展阶段、产业发展水平和技术发展现状,适度从严把握等同侵权原则的适用条件,合理确定等同侵权原则的适用范围,防止等同侵权原则的过度适用,防止不适当地扩张专利权保护范围,损害公共利益.
