我国地方党政机关办公用房的立法思考

地方党政机关豪华办公楼建设是长期以来备受各界诟病的现象。中央政府三令五申，屡禁不止，深层原因在于封建官衙建筑等级文化的遗留、官员公共财政意识薄弱及行政问责不到位、缺乏法律规制等。杜绝和防止政府办公楼建设中的超投资、超规模、超标准问题，不能仅限于现行体制内的行政措施回旋，应当及时总结国内地方的改革经验和汲取世界各国管理模式中的先进因素，进一步上升到法律层面进行调节和规制，运用法治化、规范化思维加以管理，才是符合市场经济要求的公共资产管理改革方向，也才能更为彻底地解决这一问题。

The Legislative Considerations about the Office Rooms of the Local Party and Government Organizations in China

The phenomena that the local party and government organizations build luxurious office buildings have been widely criticized for a long time. The central government has emphasized it repeatedly, but it can＇ t be forbidden because of the following deep - seated reasons ： the legacy of feudal rank culture about office architecture, the officials＇ poor sense of public finance, the absence of the administrative responsibility systems as well as the lack of legal regulations. In order to eradicate and prevent the Government from building office rooms in the super invest- ment, super scale, super standard, the central government should not be limited to administrative measures within the existing systems ; it should timely sum up the reform experience of domestic places in China and accept the advanced elements in the management modes around the world. Moreover, the problem needs to be adjusted and regulated on the legal level and managed in the legal and standardized thinking way. This is not only in line with the requirements of the market economy direction of reform in public asset management, but more thoroughly resolve this issue.
