| 摘 要： | 海峡两岸所用法律术语有相同、略有差异、不同三种情况。主要的差异是:通俗化与术语化之别,法律术语的语言规范不同,台湾法律中较多地继承中国古代法律术语。并从法制建设和有利于两岸文化交流等角度,对法律术语的命名和运用提出了几点思考。

| Abstract: | On both sides of Taiwan Strait, there are three ki nd s of situations about the legal term : the same , slightly different , different . The main difference is: Popularization and the leaving of the term , language norms of the legal term are different, inherit China's ancient legal term more in the law of Taiwan. And and favorable to such angles as two sides' cultural ex changes ,etc. from the legal construction , has proposed some thinking to the na me and application of the legal term . |
