基于少数民族习惯优化民族刑法体系的思考

我国现行刑法主要根据汉族地区发展特点而制定,并借助于大陆法系国家的立法经验,无法将少数民族中的风俗习惯等加以全面考虑。根据以往的实践经验,对少数民族习惯在刑法体系中的地位及影响因素进行总结,并从我国刑法中的基本法治理念、刑事和解制度、民族自治地方立法变通权、罪刑法定原则等方面,阐述了如何基于少数民族习惯优化民族刑法体系的问题。

Reflections on Optimizing the National Criminal Law System Based on the Habits of Minority Nationalities

The criminal law of our country is mainly formulated according to the characteristics of the development of the Han nationality,and with the help of the legislative experience of the countries of the continental law system,it is impossible to consider the customs and habits of the ethnic minorities in an all-round way.Based on the past work experience,summarizes the status and influencing factors of minority habits in the criminal law system,and on the basis of the principle of the use of minority criminal law,discusses the following four aspects:establishing the modern concept of the rule of law,clarifying the scope of application of criminal reconciliation,making good use of legislative flexibility,and adopting the legal expression of crimes.The method of optimizing the national criminal law system by using the habits of minority nationalities.
