港澳特区间《关于移交被判刑人的安排》之考察与启示

香港特别行政区政府与澳门特别行政区于2005年5月20日签订《关于移交被判刑人的安排》。该安排立法根据明确,具备坚实的现实基础,符合司法实践的要求,且突破了过去区际刑事司法协助的范围,将我国区际刑事司法协助从狭义的层面推进到了广义的层面。从内容上看,该安排比较全面地确立了区际被判刑人移交的基本规则,较为充分地体现了互相尊重司法权和刑事管辖权的精神,对于大陆与港澳特区乃至台湾地区开展区际被判刑人移交的刑事司法协助活动具有很强的示范意义。
