论私法上的“从契约到身份”运动

梅因提出的＂从身份到契约＂运动表现出相反的＂从契约到身份＂的回归,但是复归的并非古代的特权身份制度;复归的目的并不在于消灭或抛弃契约,而是要共同发挥契约与身份的社会工具性价值;并且,复归并非是学者们的臆造,而是受到新人文思潮的推动和法律主体结构变化的影响。但是,这种复归运动仍然面临我国＂缺少契约、旧身份泛滥＂的国情、原有契约理论的阻碍和新身份制度体系不完善的挑战,需要学者们发挥先锋作用,推动该运动的发展。

On "From Status to Contract" Movement of Private Law

＂From Status to Contract＂ that Maine presented recently showed the opposite trend,which is named＂from Contract to Status ＂.But it’s the return of the status’name instead of the ancient privileges of the identity system;and reversion is not aimed to eliminate or abandon the contract,but to jointly play the instrumental value of the contract with the status of society;and the reversion is not is the conjecture of scholars,but by the impact of the main structure of the promotion of human thought and legal changes.However,this reversion movement still faces many challenges,such as China’s national conditions-＂Less contract,More status＂,the original contract theory and the challenges of the new identity system of imperfect,which requires scholars to play a vanguard role in promoting the ＂from Contract to Status＂ campaign developments.
