我国现行刑罚体系之批判及完善进路管见

立足国情，充分考虑并适度预测本国犯罪现状以及社会治安状况，使刑罚的轻重衔接符合相对科学、合理的层级结构，并力求刑罚最大限度地实现行刑个别化，是建构刑罚体系应贯彻的基本理念。我国现行刑罚体系存在总体上的重刑化、具体刑种设置不周延、过分倾向于追求个案的处理效果等不足，与世界刑罚轻缓化、社会化的趋势不相一致。基于此，我国刑罚体系的改革宜从大幅削减死刑罪名入手，在完善刑种、改革有关刑法制度、改良行刑机制等方面进行突破。整个改革过程，须在一种积极、务实的态度下，统一规划，统筹兼顾，综合配套，敢于借鉴，勇于创新。

Based on national conditions and given full consideration and appropriately predicted social security and t criminal status, the basic thoughts of penalty should be that the severity of the penalty is in line with the relative convergence of scientific and rational hierarchy, and seek to maximize the execution of individual penalty. China＇s current penalty system has some drawbacks such as severe punishment, ill --defined setting of punishment, too much emphasis on the result of specific case, which is not in con- formity with the global development. For this reason, the reform of our penal system should start with the decrease of capital sentence, reform the criminal justice system, improve the execution mechanisms. The whole reform process should with unified planning and reference to foreign practice.
