实在的公正--情势差异的个案公正

公正必须是有效率的公正,或者我们将效率作为公正的必要条件.正是因为效率的必不可少,公正就不可能在国家社会的范围中完美,而只能是"相对合理"的.或者说,实在的公正是相对合理的公正,体现在情势差异的个案公正中.个案公正情势差异的影响因素主要有三个大的方面特定时期的国家社会公正价值追求(或者表现为国家社会公正和个体公正的价值选择);个体公正的情势差异;个案的本土资源差异.这三个因素也就是公正的差异评价标准.

On True Justice: Justice of Cases under Different Circumstances

Justice must be efficient and we can take efficiency as the prerequisite of justice. Because of the necessity of its efficiency, it's impossible for justice to be nationally perfect , but to be relatively rational. In other words, the true justice is relatively rational and embodies in cases under different circumstances. The reasons for this lies in the following three aspects:pursuit of the value of justice at specific stages, individual justice under different circumstances and the difference in local resources in different cases, which become the standards for judging the difference of justice.
