| 摘 要： | 通过与国外立法的比较以及对国内司法实践中的典型案例分析表明,我国刑法对金融犯罪规定死刑具有不合理性。在人权观念日益进步、法治文明逐渐彰显、刑法观念日益更新的时代背景之下,有重新审视这一立法的必要。从理论上而言,中国就金融犯罪废除死刑有其必要性;在司法实践上,可以通过适当的路径选择以达到在中国逐步废除金融犯罪死刑的目标。

| Abstract: | Comparison with foreign legislations and analysis of typical domestic cases show that it is unreasonable to sentence offenders of financial crimes to death.Backgrounded by the progressive development of human rights ideas,the gradual improvement of legal civilization and the updated criminal concepts,it is highly necessary to reconsider this provision stipulated in Chinese Criminal Law.According to the author,theoretically,there is a need to abolish death penalty applicable to financial crimes,and practically,this could be achieved by some appropriate approaches. |
