如何認識公平與效率之間的關係,是立法工作中爭議已久的老大難問題。傳統發展觀認爲,效率優先、兼顧公平;或者,在初次分配階段強調效率,在二次分配階段強調公平。長期以來,重效率、輕公平的思維定勢潛移默化地影響著各類要素市場的法律規則。
