近十年来张家山汉简《二年律令》中的刑罚研究述评

相继出土的甘肃居延汉简、湖北江陵张家山汉简等竹简填补了对西汉初期法律制度研究的空白.近十年来,张家山汉简《二年律令》刑罚的研究主要集中于对刑罚体系研究和具体刑名考证为内容的刑罚法律制度的研究,对刑罚适用一般原则和具体刑罚的适用原则为内容的刑罚适用方面的研究,以及汉初刑罚法律思想的研究.不足之处在于对刑罚的执行和刑罚的消灭制度研究不够；与同时期的其他简牍文献的比较研究尚且不够,并且对一些问题必须重新审视并考证研究.
