| 摘 要： | 教唆者自身不具体实施犯罪而是通过他人之手来达到犯罪目的的特点,使得教唆犯成为共同犯罪中最特殊、最复杂的一种情形。而教唆犯的特殊形态,即共犯形态、未完成形态、罪数形态更存在许多难以达成共识而又值得探讨的问题。
