| Abstract: | Based on the internal and external legislative and judicial practice, this paper lays stress on the analysis of the organizations which can determine the validity of arbitration agreement and their procedures, points out the advantages and defects existing in China's arbitral tribunal and court procedures. Therefore, this paper thinks that it is proper to amend the procedures and puts forward constructive advice. |
