| 摘 要： | 物上请求权的性质和类型决定着其是否适用消灭时效。取得时效和消灭时效在功能定位,制度协调上存在着不同与交叉。基于两种时效制度设计的目的,结合物上请求权,物权请求权不适用消灭时效而应适用取得时效,从而实现法的效率、公平和秩序价值。

| Abstract: | The character and type of the right of real claim determine whether it applies to extinctive prescription.Acquisitive prescriptions and extinctive prescription have similar yet not identical functions and institutions.Based on the purposes of prescriptions,China shall build acquisitive prescription in order to fill up the vacancies while the extinctive prescription shall not apply to the right of real claim in order to achieve the efficiency value,fair value and order values of law. |
