传统法律中“罪家长”制度研究——以《大清律例》为视角

儒家思想是中国封建社会的正统法律思想,等级制和家族制是儒家思想的核心。学界长期以来主要关注了君权、夫权和父权,而极少研究君、夫、父所承担的义务。本文以家族制的核心"家长"为研究对象,以《大清律例》为切入点,通过分析家长在家庭中作为夫、父、家主依法所享有的权力以及对家庭、社会、国家所承担的义务,来说明家族制中的家长不仅是权力的享有者,同时也是义务的承担者。通过对这一问题的研究,来说明我国封建社会成功设计了与当时经济、政治制度相适应的权力义务分配模式。
