中国民事诉讼法学成长的启示——以知识社会学为视角的分析

从知识社会学考察,中国民事诉讼法学成长表现为四种知识的生产,即普法法学、注释法学、理论法学、实践法学,民事诉讼法与民事诉讼法学的关系结构构成了民事诉讼法学知识生产的社会环境。每种知识的生产既是对特定关系结构的表达,受特定关系结构的制约,又参与了关系结构的创造。民事诉讼法学知识生产是在历史的变迁中进行的,又是通过民事诉讼法学家群体来实现的。

Growth of Science of Civil Procedural Law in China: Studying from Sociology of Knowledge

Studying from sociology of knowledge,one can see that growth of the science of civil procedural law in China attributes to 4 kinds of knowledge,i.e.,general law,legal glosses,legal theory and legal practice.The relationship between civil procedural law and the science of procedural law forms the social context for advancement of the knowledge of the science.Production of each kind of knowledge,an expression of the structure of the specific relationship,is not only bound by the structure but also participates in building thereof.Indeed,knowledge of science of civil procedural law is produced in the process of historical changes whereas utilized with the joint efforts of the civil procedural law jurists.
