On the Predicament of Fact Presumption in Civil Judgment and Its Way-out

In the famous Peng Yu Case of Nanjing,the fact presumption during the procedural course becomes the key point with tremendous controversy. In the civil procedure, the relevant regulations about fact presumption are not satisfying and there are lots of defects actually. Therefore,the judicial departments face a severe predicament when exerting the fact presumption rules. This essay suggests that fact presumption be perfected from such respects as legislation,justice and judges＇quality for the sake of its standard operation.
