| 摘 要： | 刑事推定在诉讼证明活动中有很强的实用价值,我国理论界对此研究不够深入,司法实践中对推定缺乏必要认识和正确运用,造成了某些案件诉讼证明及事实认定上的困难。“持有型”犯罪、赃物犯罪、共同受贿犯罪主观罪过方面以及刑讯逼供等违法取证客观行为方面运用推定时应注意一定的事项。

| Abstract: | Criminal inference has its strong practical value in the judicial testification. Research in this regard is not deep enough in our academic theory field and necessary knowledge and correct applications of criminal inference are in the lack, which have caused the difficulties of judicial testification and factual acknowledgement in some cases. |
