| 摘 要： | 刑法的社会情感性是先已存在的社会情感所决定的,是犯罪问题的社会情感性所赋予的。刑法的社会情感性通过尊重客观事实而体现刑法之真,通过促进刑罚的合目的性和刑法的正义性而体现刑法之善,通过表达同情、怜悯乃至体恤而体现刑法之美。刑法的社会情感性堪当刑法的一种精神。

| Abstract: | Social emotionality of criminal law is decided by social feeling existed and entrusted by feeling of the issue of crime. Social emotionality of criminal law embodies the true of criminal law through respecting objective fact, embodies the good of criminal law through prompting the purposefulness of penalty and fairness of criminal law, and embodies the beauty of criminal law through expressing sympathy, pity and solicitude. Social emotionality can act as a kind of spirit of criminal law. |
