中韩行政补偿制度比较研究

行政补偿是我国行政救济的重要途径之一,但与行政诉讼、行政复议等行政救济途径相比,存在很多不完善之处,其现行制度本身存在采取事后补偿、补偿方式单一、补偿标准和范围不合理等问题。韩国的行政补偿制度具有采用事后补偿,补偿标准和范围具体化、合理化,补偿方式多样化等特点,值得我国借鉴。

Comparative Study of Administrative Compensation System between China and Korea

Administrative compensation is one of the important administrative remedy in China,but compared with other administrative remedy that are administrative proceedings and administrative review,it still exists many shortcomings.In china,Administrative compensation is adapted in compensation after the fact,compensation form is unitary,and compensation standard and scope is unreasonable.However,in Korea,its compensation standard and scope is reasonable and externalize,the compensation method is diversified,and that China can learn from.
