Patent substantive condition is the admitting condition of invention. Being influenced by new technology, the patent substantive condition tends to be loose and the scope of patent subject matter protection has been enlarged continuously. Considering current level of technology development, within the framework of international convention of intellectual property rights, as to the patent application in the field of new technology, China should make strict standards for various patent substantive conditions, prevent the threshold of patent protection from being lowered, and actively participate in the formulation of relevant international convention to maintain and develop the interests of China.
