Research on Intellectual Property Dilemma and Autonomous Approach of Creative Incentive

The establishment of a professional,highly-efficient and fair dispute resolution system and the cultivation of a standardized,orderly and cooperative creative market is a vital part of idea and creativity incentive.The IPR legal system and the existing dispute resolution system,which presents some substantial dilemmas,is not the best way to realize the idea and creativity incentive.Some of these dilemmas are origin from the restriction of the nature of IP rights,and others are derived from the effi ciency and effects during the development.Idea and creativity autonomy is voluntary,professional and market-oriented,which can break through IPR legal system by bringing into full play the professionals of the fi eld.Effective measures should be taken to promote the realization of autonomy on legislative,public policy and judicial levels.
