| 摘 要： | 非法证据排除规则的确立,实际上是一个在惩罚犯罪与保障人权、实体公正与程序公正之间进行价值选择的问题。在对非法证据排除规则理论研究的同时,应加强对其司法实践的探讨,以期推动我国刑事诉讼理论和立法与司法实践的科学化、民主化、现代化。

| Abstract: | The establishment of exclusive rule of illegal evidence is one problem that chooses value between punishing crimes and ensuring human rights, entity and procedure just in fact. While making theoretical research to the rule, the discussion to administration of justice practice should be strengthened, in the hope of promoting the scientific process, democratization and modernization of the theory of criminal suit, legislating and administration of justice practice of our country. |
