试论中医师的告知义务及违反告知义务的责任

由于具有独特治疗方法,中医在医疗过程中对患者知情权的保护也颇具特色,因此,中医师对患者负有的告知义务具有特殊性。中医师不履行告知义务,则应当承担侵权民事责任。由于中医师治疗行为的特点,其承担的侵权责任形态为替代责任,应当按照医疗事故损害赔偿的一般规则确定其赔偿责任。

Due to the unique therapy methodology of traditional Chinese medicine,the legal protection of patient's rights to know in the medical process also has its identity.Faced with the patient's rights to know,traditional Chinese doctor has the special report duty.The doctor who does not implement obligation of informing should bear civil liability.In view of the therapy character of traditional Chinese doctor,the form of civil liability that he should undertake is vicarious liability.Therefore,the liability should be determined according to the rules of compensation for general personal damages or malpractice.
