知识产权反垄断法律规制中的市场支配力

在市场经济中，知识产权保护和反垄断法两者之间既存在着目标上的一致性，又存在着在实施过程中的冲突。本文拟从市场支配力的角度来分析二者之间的关系。首先对市场支配力中的相关市场进行界定，然后再分析知识产权与市场支配力间的关系演化，最后分析了专利权人滥用市场支配力行为的反垄断法规制。希望通过这个角度的分析来理清二者之间的关系。

The Market Power in Legal Regulation of Intellectual Property Monopoly

In the market economy, the protection of intellectual property and anti-monopoly law are consistent in ob- jective, however, they encounter conflicts in implementation. This paper is to illustrate the relationship between the two laws in the perspective of market power analysis. Firstly, it defines the relevant market related to market power and then makes analysis on the evolution of relationship between intellectual property and market power. Finally, it gives the illustration of anti-trust legal regulations against the misuse behavior of market power by the fight holders of intellectual property. This paper intends to clear up the understanding concerning the relationship between protec- tion of intellectual property and anti-monopoly law.
