| 摘 要： | 我国行政诉讼法中没有关于调解制度的规定,但是司法实践中又普遍地存在法院对行政案件的调解现象,与立法明文规定形成冲突。实践表明,在行政诉讼中适用调解具有现实可行性。在我国的《行政诉讼法》修改中应确定适用调解的原则,以适应和谐法治的需要。
