For private property rights,protection and restriction are co-existed systems in most contemporary countries.The starting point and foundation of the administrative compensation system is how to protecting private ownership at best when we are achieving the public interests.From the aspect of human rights protection,the paper provides that the theoretical basis and the logical review of the administrative compensation system should be corresponds of state responsibility and human rights protection.This theory may provide a new idea for constructing our administrative compensation system.
