| 摘 要： | 如何维持一种平衡的控辩关系是我国当前刑事司法制度改革的重要课题之一。我国当前刑事诉讼构造中主要呈现控辩失衡的态势。在司法改革进程中,应当以司法主体性理念为基础重塑控辩关系。通过加强对辩护律师权利的保障,建构控辩平衡的诉讼构造,以实现程序正义和人权保障。

| Abstract: | It is one of an important problem that how to keep a balance relationship between the prosecution and the defense, and the relationship between the prosecution and the defense display unequal situation in our nation now. On the progress of judicial reform, we should reestablish the relationship between the prosecution and the defense on the base of spirit of judicial subject. By the ay of reinforce the right of lawyer, rebuild the structure of criminal procedure with a balance relationship between the prosecution and the defense, our purpose is achieve the process justice and human right safeguard. |
