| 摘 要： | 刑法学界对单位犯罪的处罚方式一般都认为有双罚制和单罚制两种。单位犯罪单罚制存在标准不确定、单位的诉讼地位不确定等弊端,从而使得单位犯罪单罚制在适用过程中存在不完善之处。应该对刑法中的单罚制处罚方式进行部分修改,以实现法律完善和适用上的统一。

| Abstract: | There's a common views that there are two kinds of punishment principles in unit crimes in China criminal law. The single punishment principle in unit crimes has some shortages while being applied, such as the indetermination of the standard and the situation of the units in litigation. In order to perfect the law and unify the application of the law, we should partly amend the regulation related to the single punishment principle. |
