国际项目融资中的环境争端及其解决——以新加坡丰益集团印尼棕榈油项目案为例

The Environment Dispute in International Project Financing and Settlement Thereof:Taking Indonesia Palm Oil Project of Wilmar Group as an Instance

How to avoid and resolve the environment disputes related to the international project financing has become a common concern for the governments,investors,local community and international organizations.That is why international society pays so much attention to the case of Indonesia Palm Oil project of Wilmar Group.It is the Office of the Compliance Advisor/Ombudsman(CAO) that addresses the case,which allows individuals,community groups,local and international NGOs affected by projects to lodge a complaint for the social and environmental problems.CAO reviews the case according to IFC’s Performance Standards as well as some NGOs’ ideas and guidelines.This makes the private parties become an important role in the disputes and settlement thereof.The government of host country should amend its domestic laws in good time and observe NGOs’ action to avoid disadvantageous outcome.
