论宪法解释的对象

宪法解释对象是宪法解释的首要问题。宪法理论界至今存在宪法说、宪法条文说、宪法规范说、宪法文本说四种关于宪法解释的学说,都难免有模糊不清的缺点。笔者从宪法渊源的角度展开分析,首先从一般意义上分析宪法典、宪法性法律、宪法惯例是否可以作为宪法解释对象,然后着眼于中国宪法文化的特点分析中国宪法解释对象的特殊性。通过区分宪法解释学和解释实践上的宪法解释对象,从而限定宪法解释对象理论的意义。

A Review on the Objects of the Interpretation of Constitution

The primary question of the interpretation of constitution is to identify its objects.So far,there have been mainly four theories on the interpretation of constitution in the theoretical circle,which are the theory of constitution,the theory of constitution articles,the theory of constitution norm and the theory of constitution text.But all the four the- ories are ambiguous to some extent.Therefore,the author intends to i- dentify the objects of the interpretation of constitution from the perspec- tive of constitution's origin.
