| 摘 要： | 不起诉听证制度是检察机关在对刑事案件拟作出不起诉决定后,广泛听取各方意见的一种内部工作机制,有利于保障当事人的程序参与权,促进司法公开公正。应从不起诉听证的适用范围、启动程序、举证质证及效力等方面入手,构建并不断完善我国的不起诉听证制度。

| Abstract: | Non-prosecution hearing system is an internal working mechanism to listen to views of all parties after procuratorial organs decide to make a non-prosecution decision of criminal cases,which is helpful to protect the party’s participation in the proceedings and promote judicial openness and fairness.Non-prosecution hearing system of our country should be built up and constantly improved through its scope of application,starting program,burden of proof,cross-examination,effect,and so on. |
