职业许可的概念界定

职业许可是资格许可与行为许可的结合,具有强烈的人身专属性,但不具有排他性。从法律属性看,职业许可以对公民职业自由的一般性限制为前提,系对公民职业自由的法律化转换。职业许可与营业许可、职业认证等之间,既有一定联系,也存在明显区别。

On the Concept of Occupational Licensure

Occupational licensure is the combination of approval for both occupational qualification and occupa -tional conduct , with a strong personal attributes , but not exclusive .In terms of legal character , occupational licen-sure which takes general restriction on citizens'occupational freedom as the premise , transforms the citizens'occupa-tional freedom from a natural right into a legal right .And there are some relationships as well as some significant differences, such as the restricting content , purpose , objective and entry barriers , between the occupational licen-sure and business licensure , occupational certification , etc.
