| 摘 要： | 法律是文化的产物。近代以来西方罪刑法定的产生与演变是与西方文化息息相关的,中国当代的罪刑法定则深受中国传统文化和西方文化的双重影响。我国的罪刑法定原则无论是在制度层面,还是在实务层面,都存在局限和不足,需要通过文化和制度的建设来弥补和完善。

| Abstract: | The law is the cultural product.Since the modern times the western crime punishment legal production and the evolution have been closely linked with the western culture.The Chinese present crime punishment legal actually is influenced deeply by China traditional culture and the western culture.In our country,criminal punishment legal principle not only in the system stratification plane,but also in the solid service stratification plane,has the limitation and the insufficiency,and needs to make up through cultural and the system construction. |
