"软秩序"与"和谐"--探寻民族地区和谐法治建设的阻滞与路径

在法治化推进的同时,民族地区有效地存在着一种独特秩序,它的存在是多种因素综合作用的结果,包括经济、文化、风俗习惯、固有的解决方式等等。但是分析民族地区这种软秩序并不是提倡这种秩序的存在。在法治研究上不仅仅要认识到这个秩序存在的理由,更应该注重法治在民族地区推进中的方式,注重对我国民族地区和谐法治建构的反思。
