| 摘 要： | 在我国全面推进依法治国，加强人权保障的时代背景下，公安机关大力推行人性化执法，人民群众的权益得到切实保障。但是与此同时，公安民警的行政执法权益却日益遭受不法侵犯，公安机关的执法权威受到威胁。针对这一问题，加强执法强制性与人性化相均衡很有必要性，我们应积极探寻完善现阶段公安机关正确处理行政执法与保障人权之间平衡关系的途径。
