| 摘 要： | 我国专利法第25条规定时科学发现、智力活动的规则和方法、疾病的诊断和治疗方法、动物和植物品种、用原子核变换方法获得的物质不授予专利权,不利于保护原始发明和工序发明,不利于保护投资。《专利法》第三次修订应取消第25条不授予专利权条款,平等保护发明,激励全员创新。
