论村民委员会的性质和职能

村民委员会承担着政治、经济、社会的多种职能,是我国农村社会极其重要的社会主体,但无论是法律规范上,还是实际运作中都没有对其作出清楚准确的定位,导致其性质不清、职能不清、法律人格不清,致使农村社会成为社会矛盾的多发地带,甚至影响到农村经济体制改革的进一步深化。因此,重构村民委员会的性质、职能就成为当务之急。将村民委员会定性为村民自治、协助基层政权、监督集体资产运营的组织,将具体经营管理集体资产的职能剥离出去,赋予其类似于《民法通则》中的事业单位法人地位。

View on Character and Function of Chinese Villager Committee

Assuming many political,economic and social functions,the villager committee is a very important social main body in Chinese rural society. However,its exact definition has not been made clear whether in laws and regulations or in practice. So the social conflicts often take place in rural society,and even influence the further deepening of the reform of rural economic structure. Therefore,it is greatly urgent to redefine the character and function of the villager committee.The villager committee should be determined as an organization with the nature of villagers self-governing,assisting regime in grass roots and supervising the running of the collective assets.It should be abridged the function of concretely managing the collective assets.It should be endowed with something like enterprise of corporation status in General Rule of Civil Law.
