| 摘 要： | 《物权法》第20条对预告登记适用范围的规定由于存在着界定不准、语意不明和范围狭窄、局限太多等问题,受到法学界的普遍关注,就完善这一内容大家提出了很多建议。从预告登记适用范围的界定标准来看,受预告登记保护的应当是债权请求权而非物权,申请预告登记的前提条件是暂时无法办理本登记,预告登记所保全的债权请求权应当日后能转为本登记。
