| 摘 要： | 民事抗诉是检察机关监督人民法院审判工作的一种重要途径。但是,由于法律规定的不明确,导致在实践中,法院和检察院在抗诉的许多方面都发生了严重的冲突,进而严重影响了民事抗诉活动的正常运行和作用的发挥。
