| 摘 要： | 国际私法的法律选择方法经历了由单边主义方法到多边主义方法,再到后来融人实体主义方法的演变过程,这一过程既反映了国际私法的价值由追求形式正义到追求实质正义的取向,也体现着对国际私法的价值的定位由以国家利益为出发点发展到以国际社会“主权共享”利益为出发点,最后回归到以私人利益为出发点和落脚点的发展过程。因此有必要对这种定位的变化及其原因和影响进行分析,以更好地指导实践。
