关于民事责任能否转换为刑事责任的研讨

民事责任和刑事责任的产生,源于不同的理论基础和价值取向,以客观存在的民事违法行为和犯罪行为为前提。在我国现实存在的司法解释之中,民事责任出现了向刑事责任的转化倾向,值得关注。刑事案件中民事赔偿责任的积极履行状态,可以有限度影响到刑事案件的量刑,这是可以接纳的刑事责任微调。但是,无能力赔偿而导致的由民事侵权向刑事犯罪的转化,即由非罪向罪的转化,是一种必须加以遏制的逆向转化。

Criticism of the Tendency of the Transition from Civil Liability to Criminal Responsibility in Judicial Practice

Civil liability and criminal responsibility come from different theories and value tendencies,and from the different premises of objective civil misfeasor and crime,in the now going constructions,it is worthy of observing that there is a tendency of the transition from civil liability to criminal responsibility.In criminal cases,the fact that the condemned persons actively pay the compensation may influence the sentences in a limited extension,which can be took as the slight adjusting in criminal responsibility.However,the transition from tort to crime,which arises from the incapable compensation,instead,the transition from innocence to guiltiness,is a converse transition that should be prevented rigorously.
